Terms and Conditions



ARTICLE 1: Purpose
 
The following general terms and conditions of sale detail the rights and obligations of the "casaelle" store and its customers regarding the sale of products listed on the site.
Any service provided implies the buyer's unconditional acceptance of these general terms and conditions of sale.



ARTICLE 2 : Products

The characteristics of the products offered for sale are presented in the "Products/Categories" section of the site. Since photographs are not part of the contractual scope, the seller cannot be held responsible for any errors in them. All texts and images presented on the site casaelle.com are strictly reserved, worldwide, under copyright and intellectual property rights; their reproduction, even partially, is strictly prohibited.


ARTICLE 3 : Prices

Prices are indicated in euros, including all taxes, excluding processing and shipping fees. Shipping costs are displayed on the cart page: entering the country will show the available delivery methods and their respective rates. "Casaelle" reserves the right to change its prices at any time, but the product will be billed based on the rate in effect at the time of order confirmation.


ARTICLE 4 :  Order

Any order confirmation implies the buyer's full and unconditional acceptance of these general terms and conditions of sale, without exception or reservation. All data provided and the recorded confirmation will serve as proof of the transaction.
The customer is required to provide all necessary information for delivery and must verify the completeness and accuracy of the information provided. The store cannot be held responsible for any errors in input and the resulting consequences in terms of delays or delivery errors.
The customer confirms their cart by activating the "PAYMENT" button, after selecting the delivery method. A confirmation email detailing all elements of the order is sent to the customer. The recorded data constitutes proof of the nature, content, and date of the order. The order is archived in accordance with legal conditions and deadlines, and the customer can access this archive by contacting customer service.


ARTICLE 5 : Payment

Validating the order implies the obligation to pay the indicated price.
Payment for purchases is made via the secure PayPal service, either through a PayPal account held by the customer or by credit card if the customer does not have a PayPal account.
The seller disclaims any responsibility in the event of data loss by PayPal and cannot be involved in any compensation process that would be due by PayPal.
Our buyers' banking information is never transmitted to us by PayPal, and we will never ask our customers to confirm their account or credit card details by email.



ARTICLE 6 : Withdrawal  - Products returns
 
In accordance with the provisions of Article L.121-21 of the Consumer Code, the buyer has a period of fourteen (14) clear days from the receipt of the products to exercise their right of withdrawal without having to provide reasons or pay penalties, except for, if applicable, the return shipping costs. However, before any return, the buyer must inform the seller of their decision to withdraw either by sending the downloadable withdrawal form via email or through the "Contact" tab on the store's website. Exercising the right of withdrawal will result in either a refund of the total amount paid, excluding shipping costs, as soon as possible and no later than fourteen days following the date on which this right was exercised, via the same payment method used for the order, or an exchange of the product, provided that the items have not been used and are returned in their original packaging.

Return shipping costs are the responsibility of the customer. Sale items are neither returned nor exchanged.

ARTICLE 7 : Delivery and shipping costs
 

Shipping costs are indicated on the cart page: entering your country will show the available delivery methods and their respective rates. The store delivers to France, Switzerland, and European Union countries. Orders are processed within 24 to 48 hours after payment is received and are shipped according to your choice via:

  • La Poste :

  1. Tracked Letter (for small, lightweight items)

  2. Colissimo tracked deliveries without signature for France, with the choice of home delivery or pickup a a Post office point

  3. Colissimo International for the European Union and Switzerland.

 

Estimated delivery times by La Poste are 2 to 3 business days for France (indicative) and 2 to 4 days for the EU (indicative).

  • Relais Colis : Delivery to pickup points for France only. Indicative delivery time: 4 to 6 business days.

  • Mondial Relay :

         Delivery to pickup points or Home Delivery

  • France, Belgium, Luxembourg (average delivery time 3 business days), 

  • Germany, Netherlands, Spain, Portugal, Italy (5 business days)

  • Austria (6 business days)

Click & Collect : The store also offers in-person pickup at the showroom.

In the case of orders to a country other than metropolitan France, any customs duties or other taxes are the responsibility of the customer. Shipping costs include postage and packaging and are calculated based on the total weight of the package on the "Cart" page when the customer enters their delivery address.

If the buyer has not received his order within thirty days from the order date, the sales contract may be canceled, and the buyer will be refunded as soon as possible. Packages are carefully prepared; therefore, the seller cannot be held responsible for any delays, loss of packages, or damage incurred during transport. The customer is required to inspect the package in the presence of the delivery person. In case of a damaged package or signs of tampering, do not accept the package.

ARTICLE 9 : Privacy Policy

 

"Casaelle" is committed to respecting the privacy of users of its website and ensures that all personal information is treated confidentially. Personal data is essential for processing and shipping orders. The personal information collected includes: name, first name, postal and email addresses, and phone number. This information is never shared with third parties. For sending commercial communications, data processing is based solely on consent through newsletter subscription. Users can unsubscribe from the newsletter at any time by clicking the link provided at the bottom of each newsletter.

In accordance with the "Informatique et Libertés" law of January 6, 1978, amended in 2004, the processing of personal data has been declared to the CNIL under number 1934971 v0. Users of this site have the right to access, rectify, and oppose their personal information and data. ARTICLE 10 : Cookies

The site uses cookies, which do not identify the user but record browsing data for statistical purposes, to allow for tracking and improvement of service quality. "casaelle" is a registered trademark with the INPI. This registration grants it protection under the legal provisions (Article L 711 and following, and R 712-1 and following) of the Intellectual Property Code, and by Directive 2008/95/EC.
All texts and images presented on the website casaelle.com are strictly reserved, including downloadable documents, under copyright and intellectual property rights. Their reproduction, even partial, is strictly prohibited without express authorization.



ARTICLE 12 : Applicable law

These general terms and conditions of sale are governed by French law. In the event of a dispute, the buyer agrees to first contact the seller through the 'contact' section of the shop. If no agreement is reached, only French courts will have jurisdiction.


ARTICLE 13 : Modification of general terms and conditions of sale


The seller reserves the right to modify these general terms and conditions of sale at any time. However, the terms and conditions applicable to an order placed by a customer on the site are those accepted by the customer at the time of placing the order.
Despite the utmost care taken in the creation of this site, the seller cannot be held responsible for any potential errors that may have slipped into the information and documents presented
